DMCA Policy
Windy Haus Design respects the intellectual property rights of others. We expect our users to do the same. This policy details our procedures regarding claims of copyright infringement and how to file notices in compliance with the Digital Millennium Copyright Act (DMCA).
Our Commitment to Intellectual Property
As a website publishing articles, including those about interior design and related topics, Windy Haus Design recognizes the importance of protecting original content. We aim to ensure that all material published on windyhaus.com respects existing copyrights. We will respond quickly to notices of alleged copyright infringement that comply with the DMCA.
Filing a DMCA Takedown Notice
If you believe content on windyhaus.com infringes your copyright, you may send us a formal DMCA Takedown Notice. Your notice must include all the following information:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed. Please provide specific details, such as the title of the work and its location if published elsewhere.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity. You must provide information reasonably sufficient to permit us to locate the material on windyhaus.com. This includes the specific URL(s) where the alleged infringement occurs.
- Your contact information, including your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please send your DMCA Takedown Notice to our Designated Copyright Agent:
- Email: [email protected]
We review all valid notices and will take appropriate action, which may include removing or disabling access to the infringing content. We will aim to process such requests within two business days.
Counter-Notification Process
If your content was removed due to a DMCA Takedown Notice and you believe the removal was a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which Windy Haus Design may be found). You must also state that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Please send your counter-notification to our Designated Copyright Agent at [email protected]. Upon receiving a valid counter-notification, we may restore the removed material within 10 to 14 business days, unless the copyright owner files a court action seeking a court order to restrain the user from engaging in infringing activity.
Repeat Infringer Policy
Windy Haus Design operates a strict repeat infringer policy. If a user is found to have repeatedly infringed copyright, we will terminate their access to our website and services. We reserve the right to determine what constitutes repeated infringement.
